- W124329346 abstract "Non-profit, private organizations have become so much a part of American life that almost every adult possesses some affiliation. Religious groups, unions, political parties, social and hobby clubs, and trade and professional associations are the general categories into which private organizations are grouped. While membership requirements may vary enormously from no standards at all to the most rigid criteria people who achieve membership in trade and professional associations, which are the focus of this article, normally wish to retain their affiliation until they voluntarily decide to withdraw. The interests of associations, on the other hand, often require that procedures be available for the discipline or expulsion of members. Many associations have as a principal purpose the maintenance or enhancement of standards of conduct and practice in their trade or profession and consider the task of disciplining or expelling members who violate these established standards a necessary ingredient in maintaining the meaningfulness of such standards to the association. For indeed it is. First, if properly publicized, the imposition of some form of sanction upon those members who violate established standards of conduct or practice will hopefully act as a deterrent to future misconduct by the entire membership. Second, the suspension or expulsion from membership of persons who have violated established norms will protect the association and its remaining members from the stigma which would otherwise develop because of their connection with persons who have engaged in improper conduct. When the goals of an association and an individual conflict, with the association seeking to discipline a member who, in turn, is attempting to preserve his good standing, it becomes necessary for the association to possess some mechanism to resolve the conflict. From the perspective of a member, the opportunity to present his defense to any proposed disciplinary action will, to the extent permitted by the available procedures, provide him fair treatment and insulate him from personal animosities and jealousies. From the association's perspective, a formal disciplinary procedure will protect against actions motivated by prejudice and capriciousness characteristics which, if present in a disciplinary proceeding, would undercut the very standards which the organization is seeking to preserve.
