- W12560929 abstract "Despite lavish attention paid to Ninth as a possible source of unenumerated rights, surprisingly little attention has been paid to actual text. Although often raised in opposition to reading Due Process Clause as incorporating only textual rights, text of Ninth has nothing to do with interpretation of enumerated such as those contained in Fourteenth Amendment. No matter how narrowly one construes Fourteenth, Ninth merely demands that such enumerated not be construed to or disparage other by people. In fact, standard theory of Ninth places text in considerable tension with that of Tenth. Although both Ninth and Tenth Amendments close with same reference to the most contemporary scholars and courts treat same term in two amendments as having opposite meanings, with Ninth referring to a single national people and Tenth referring to people in several states. Finally, recent historical evidence reveals that for more than one hundred years after its enactment, courts applied Ninth Amendment in a manner that preserved autonomous of states. This seems out of sync with a text that speaks only of of people, not states. This article addresses these and other textual mysteries of Ninth Amendment. The over-all effort is to construct a text-based theory of Ninth that both explains its historical application and reconciles Amendment with other texts in Constitution such as Tenth and Fourteenth Amendments. Particular attention is paid to meaning of deny or disparage, distinction between rights retained and rights assigned, and relationship between by people under Ninth Amendment, and powers reserved to people under Tenth. The article closes by sketching a textual-historical approach to judicial enforcement of Ninth Amendment in a manner that reconciles text with Fourteenth Amendment." @default.
