- W13701133 abstract "Relational feminism which holds that the essential difference between men and women is that women are profoundly relational (essentially connected to the rest of human life) whereas men are autonomous represents what is perhaps the most popular form of feminist legal theory. The authors of this article challenge the preeminence of relational feminism which they consider dangerous and misguided and which they believe stands in with womens felt needs particularly as those needs are expressed in the feminist legal agenda and most especially in the area of reproductive rights. Part 1 of this article discusses the notion of relational feminism as set out by Carol Gilligan in her book In a Different Voice. Gilligans critique of existing theories of moral development is presented as are her concepts of the different voice and the ethic of care which present an alternative theory of moral development. Part 2 explores abortion theory to show that the different voice speaks largely against abortion rights. The Supreme Courts invocation of relational concerns in abortion decisions is also explored and the ways that relatedness and connection are used to justify restriction on reproductive freedom are revealed. A focus on Gilligans abortion studies reveals that Gilligan herself largely elaborates relationalism beyond recognition in an attempt to resolve the tension caused by the priority that womens experience must take over relational theory. Part 3 asks whether there are any ways to reconcile relational feminism to womens needs and concludes that proposed accommodations only salvage relational feminism at the cost of making the theory incoherent. By challenging relational feminism however the authors do not imply an endorsement of its opposite. Instead they conclude that any feminist theory seeking to inform law should be rooted in feminist politics particularly in womens actual needs experiences and history of oppression. Ignoring the politics of social construction dooms us to mistake difference for dominance and relation for subordination.
