First, while both the procedures and the goals of science and law differ enormously, we should recognize that similarities do exist. The principal similarity is that both are in the business of acquiring information, sifting and organizing it, and then drawing conclusions or making decisions. The two disciplines typically address different types of topics, with the result that different techniques and cultures evolved. Both disciplines address uncertainty, and both predict and try to change the future. Apart from the more obvious differences in methodology, it is interesting to consider the even greater differences or at least the perceived differences in the cultures of the two disciplines. Warren Muir described law as involving extrapolations for establishing new norms. But is it fair to consider a single paragraph of the Sherman Antitrust Act, which established in large part the economic structure of the United States and to a lesser extent the world, an incremental extrapolation? On the other hand, many scientists seem to wish their work be seen as proving a theory have and applying a principle to a problem there in general, conducting a business of small extrapolations. I submit that the greatest differences between the disciplines are in their cultures. Second, scientists historically may be somewhat self-critical in considering use of the method their only valid activity. Perhaps scientists think the public views science as the embodiment of truth and, therefore, that the scientists' methods will be helpful in other settings in identifying truths. Scientific method and peer review set standards against which the public can compare many other decisionmaking processes. I have the impression that only a small percentage of what rightly can be called scientific effort is dedicated toward fundamental research.
