- W139176048 abstract "Gentlemen, I am confronted with something of a dilemma. I had a law school professor who contended (admittedly with a twinkle in his eye) that, while the statue of limitations was a perfectly valid legal defense, it was a defense that a true gentleman would never plead. I have reviewed the documents in this case and, as I understand it, this is the first institute the American Bar Association has ever held on the general subject of pollution. A review of the record also shows that the first federal water pollution control law was enacted in 1948. That, as all of you can quickly calculate, was twenty-one years ago. While I am not prepared to make an immediate ruling, I suggest the possibility that, even if lawyers are not barred by an ungentlemanly plea that they have failed to timely exercise an interest in pollution, you may indeed be confronted with the fact that others have already taken title to the pollution field by adverse possession. The 1961 amendments to the Federal Water Pollution Control Law were controversial. I know, because as Assistant Secretary of the Department of Health, Education and Welfare I was involved in much of the in-fighting. One of the underlying issues was, that Act was aimed at removing the doctors from water pollution. It succeeded. The '61 amendments moved the administration of the program away from the U.S. Public Health Service. And four years later it was moved out of the Department of Health, Education and Welfare entirely into the Department of Interior. The 1956 amendments to the Federal Water Pollution Control Law were also controversial. I know, because as a member of Congress I had to vote on the contested issues. But one of the things that the 1956 amendments did, that nobody argued about was removing the lawyers from water pollution. Maybe, we did not know we were doing that; perhaps we did not intend it. But, in retrospect, I am persuaded that that has been the effect of the 1956 Federal Law. What is more, I am not so sure that it was not done with malice aforethought. Let me explain." @default.
