- W145761805 abstract "In recent years there has been a significant increase in the number of court cases dealing with the dismissal of public school teachers for immorality, turpitude, and unfitness to teach. Several factors have contributed to this trend. Among them are the acceptance of so-called situational ethics by large numbers of Americans, the gay liberation movement, the wide spread use of drugs and other controlled substances by young people, and changes in standards of sexual conduct. Teachers have been swept up in the currents of rapidly changing social norms and may have run afoul of laws that they believe reflect antiquated moral principles. In addition, teachers, supported by well-organized and well financed professional organizations and unions, appeal dismissals more frequent ly than in the recent past. Furthermore, the courts have recognized that public school teachers acquire property rights in their positions and therefore cannot be dismissed arbitrarily or capriciously without due process.1 Terms as immorality and moral conduct are difficult to define, since subjective judgment is involved. Nevertheless, the courts have attempted to give clearer meaning to these words, because they often appear in statutes. In 1920 the Supreme Court of Minnesota held that immoral conduct includes such acts and practices as are incon sistent with decency, good order, and propriety of personal conduct.2 Simi larly, the Supreme Court of Oklahoma indicated that immoral conduct is that conduct is willful, flagrant, or shameless, and which shows a moral indifference to the opinions of the good and respectable members of the com munity.3 A broader, but by no means comprehensive, definition of immorality was supplied by the Supreme Court of Pennsylvania when it declared that im morality is not essentially confined to deviation from sex morality; it may be a course of conduct as offends the" @default.
