- W1479915690 abstract "A number of accusations are made against the Indian Police that they apply third degree methods in eliciting information and there are instances of the culprits or suspects dying in lockups during the course of interrogation on account of application of third degree methods, therefore, there is a blame that the Indian Police are flagrantly violating the human rights and fundamental right to life and personal liberty guaranteed under Article 21 of the Constitution of India. As a result, it was felt that there is a need to apply scientific tests such as the Narcoanalysis, the Polygraph and the Brain Mapping tests (hereinafter referred to as tests) to elicit the information from the culprits or the suspects in getting the information to make further investigation in the crimes. Although these are considered as scientific tests, they do not yield fool proof results because of which there have been serious considerations as to its evidentiary value. Another issue with respect to administration of the tests is whether the information availed through involuntary administration of the tests amounts to violation of the right against self incrimination.Till recently there was no clear view of the judiciary as to the constitutionality of involuntary administration of the tests and its admissibility in a court of law. Finally in the year 2010 the Supreme Court in Smt. Selvi and Ors. v. State of Karnataka declared involuntary administration of the tests as unconstitutional on the ground that it not only violated one’s fundamental right against self incrimination but also the right to life and personal liberty apart from violating rights guaranteed by the international community in the Universal Declaration of Human Rights and the International Covenant on Civil and Political Rights. The beginning paragraphs of this article gives an overview about the procedure involved in the administration of each of the tests, followed by its use as a tool of investigation, admissibility of the information availed through the tests and the views of the High Courts in this respect. The last part of the article deals with the land mark decision laid down in Selvi’s Case addressing all the issues related to the involuntary administration of the tests." @default.
