It situates the Court within the broader organizational architecture of the parent body, the ECOWAS. It traces the historical milieu and trends that provided the needed impetus for formation of a regional economic community in West Africa, leading to the formation of the ECOWAS. It discusses the development of the organization in terms of achievements, obstacles and challenges as well as developments within the regional, continental and global environment that compelled the organization to embark on institutional reforms, a major component of which was the establishment of a Court of Justice as an Institution of the Community. It notes the delayed arrival of the Court as a product of inadequacies in the legal texts and other instruments. It situates the emergence and development of the Court within the broader institutional reforms that pay attention to the need for the regional integration efforts in West Africa to conform to global standards and respond effectively to developments within the contemporary international system. The paper also examines the positions of the various institutions of the Community within the organizational structure of the ECOWAS: their establishment, functions and powers, as defined by the Treaty and the Protocols relating to anyone of them, paying particular attention to the respective position of each institution in relation to the work of the Court of Justice. By doing this, it highlights the Court’s role, in relation to the other institutions of the Community, within the organizational architecture of the ECOWAS. As an institution designed to play a central role in furtherance of the goals of regional integration, the success or otherwise of the Court will necessarily be constrained by the symbiotic relationships that exist or are expected to exist between the ECOWAS Court on the one hand and other leading Institutions of the Community on the other hand. By doing this, one can expect to have a better understanding of how the work of the Court impacts on the work of these other Institutions, and vice versa.The Community Court of Justice, as presently constituted, is not among the Institutions created under the original 1975 Treaty that established ECOWAS. The original Treaty provided for only four “institutions of the Community” and four Technical and Specialized Commissions. The recent addition of the Court of Justice and the Community Parliament, as well as the transformation of the Executive Secretariat into a Commission, among others, to the range of institutions created to re-invigorate the 4-decade old organization in its efforts towards integration of the West African sub-region is not a mere accident of history. It is at once a reaction to and culmination of historical developments, both those that are endogenous to the sub-region and other that have a wider international dimension. The historical ecology that propelled the creation of the Court necessarily constrained the role envisioned for it under the revised treaty of the ECOWAS. Its emergence in 1991 was part of the efforts targeted at reforming the ECOWAS to meet the several challenges of development that had slowed down the progress towards economic integration in the West African region. It was not the only institution so newly created, however. Although the Protocol creating the new Court predated the comprehensive revision of the original Treaty by two years, the ECOWAS Court was just one among the several other Institutions created under the Revised Treaty of 1993. The other Institutions of the ECOWAS created under the new Treaty include the Authority of Heads of State and Government, Council of Ministers, Executive Secretary (now renamed President of ECOWAS Commission since 2006), Community Parliament, Economic and Social Council, Arbitration Tribunal, and a number of Technical Commission (now renamed specialised technical committees). The addition of the new Institutions, notably the ECOWAS Parliament and the ECOWAS Court, and strengthening of the existing ones followed essentially the new vision of regional integration in West Africa, patterned along the path already developed in the EU.The comprehensive revision of the original 1975 Treaty of ECOWAS was informed by a number of developments, within and outside the region, that necessitated a radical restructuring of the forty-year old organization with a view to transforming it into a veritable instrument of regional integration in the sub-continent of West Africa." @default.
