Our popular newspapers fill their pages with crime because that is what sells copies, and even a mildly sensational case fills the court with spectators; the eighteenth century avidly read the Newgate Calendar (as sordid a publication as ever was the Daily Thingummy or the London Moon ), gaped at prisoners through bars and attended executions; the sixteenth enjoyed on the stage nothing better than criminals whether contemporary (Arden of Feversham) or historical (Timon of Athens ). Since at least until the eighteenth century the accident of record survival biases the weight of the evidence towards the work of law courts, the people of whom we are most likely to know – at least below the level of the great and powerful – are those that came into conflict with the law. And yet, the present outburst of social history has been slow to turn its attention to crime, leaving that matter still to the kind of writer whose books bear titles like Olden Days Punishments or Highwaymen I have Known . The dearth of serious studies forces the historian to rely on Sir Leon Radzinowicz's massive History of English Criminal Law and its Administration from 1750 , for his purposes much too much a lawyer's book, with its deferential attitude to ‘the authorities’ and its rather uncritical treatment of sources." @default.
