The ecologically rich waterway was the reason the Oneidas decided to settle in northeastern Wisconsin when they left New York State in 1822. Duck Creek was a source of sustenance for food and economic goods, and it was a community meeting place. Today, the white pine and black ash forest, trout, mink, and eagles are struggling to regain their rightful place in the Reservation environment. Protection and restoration of the environment reflects the efforts of many, and, at times, progress is not visible. The story of how the Oneida Environmental, Health and Safety Division (EHSD) is succeeding at this work is rich with politics, money, and historically institutionalized racism. The Oneida Tribe of Wisconsin was one of the first tribes in the country to be approved for treatment as a state (TAS) for regulatory program purposes under the Clean Water Act. 33 U.S.C. § 1377. A decade ago, on December 19, 1996, the U.S. Environmental Protection Agency (EPA) approved the Oneida Tribal Water Quality Standards and the Tribe assumed the authority for Section 401 certification, for Section 402 (NPDES), and Section 404 (dredge and fill) permit applications for activities on the Reservation. 33 U.S.C. §§ 1341, 1342, 1344. Oneida staff issued certifications for one tribal and two nontribal permits under new authority. The State of Wisconsin, local municipalities, and a manufacturing association sued EPA, challenging their decision to approve Oneida water-quality standards on a variety of grounds (96-C-0329). In the Wisconsin case, EPAs administrative record became a serious and substantial problem in the authority approval process according to the District Court decision. Citing irregularities in the development of the administrative record, on May 16, 1997, EPA rescinded its decision that the Tribe is eligible for TAS for the water-quality standards program.
