- W153328717 abstract "When the physical or mental condition of a party is at issue in a lawsuit, the adverse party may move the court for an order requiring that person to submit to an examination of his or her physical or mental condition.1 Such an examination most often occurs in personal injury lawsuits where the existence of an injury and the nature and extent of the damages sought are often dispositive. In dissolution cases, when the custody of minor chil dren is disputed, the physical or mental condition of a party can be a crucial factor in the court's determination of which party will be awarded custody. Therefore, Rule 35 may come into play in these cases as well. Indeed, precisely because most judges, trial and appellate, consider parents' mental health and emotional stability so important to healthy child devel opment, Rule 35 and its subsidiary doctrines are likely to play an impor tant role in a great many contested custody cases. This article examines the use of Rule 35 to compel an adverse psycho logical examination of a party and/or the disclosure of a party's mental health records in a child custody dispute from two perspectives: the tacti cal concerns of a practicing lawyer in a contested custody case and the perspective of a judge required to determine the best interests of the child whose custody is being contested." @default.
