A photograph (which I have not seen) by Andres Serrano of a plastic crucifix immersed in a bottle of the artisťs urine, Piss Christ won a prize funded by a federal grant, sparking proposals to attach conditions to public support of the arts that would prevent future public subsidies of blasphemous, obscene, or otherwise offensive works. The questions raised by the Serrano work were shortly afterward exacerbated by the removal from the Corcoran Gallery of an exhibition, also supported by public funds, of photographs by the late Robert Mapplethorpe on subjects homoerotic and, some have argued, sadomasochistic into the bargain. Among the photographs (which, again, I have not seen) is one that is reported to show a black man urinating into the mouth of a white man. But I shall concentrate on Piss Christ, which poses the issue of public regulation of offensive art in a particularly useful way. Despite or perhaps because of my being a member of the judiciary, I do not want to discuss the legality of proposals to restrict public funding of offensive art. I want instead to discuss the larger philosophical and jurisprudential issues raised by such art. Concretely I want to argue that nowadays there is no objective method of determining what is art or what is offensive, and to consider whether, if this is right, it implies that offensive art should get a lot, or a littleor even noprotection from governmental interference, however that interference should be defined in this setting. For example, is it interference when the government grants, or when it withdraws, a subsidy to the arts? When we say that lead is heavier than aluminum or that an automobile is faster than a rickshaw, we make a statement that can be verified by methods independent of the tastes or personal values of the people doing the verifying.
