- W156190568 abstract "Contemporary writings in the area of divorce show concern with the plight of the spouses involved in adversary proceed ings. It is time, however, that these proceedings be enlarged so as to include the preservation of rights of any children who may be involved. Almost without exception, the right to children, as adjudicated in custody proceedings,1 is determined by com paring the fitness of the contesting parents: the children are treated as secondary parties in these proceedings. The present judicial treatment of children in custody hearings is best de scribed by the adage, Children should be seen and not heard. This approach is opposed to increasing judicial recognition that children have rights which no longer can be ignored. Regardless of the recent controversy in the field of di vorce?retention or abolition of the marital concept?the principle that a child has a right to representation at a custody hearing is of great import. To abolish fault in divorce is not to abolish questions of custody and the following discussion is applicable irrespective of the divorce law in the particular juris diction. The prime purpose of a custody hearing is a determination of the best interests of the child. It is the thesis of this article that the best way to realize this goal is to grant the child counsel." @default.
