- W161918552 abstract "ESTABLISHED in March, 1947, the government's program moves into its fourth year. The program presents a complex problem: whether, in the name of loyalty and national security, our society is justified in abusing most of the basic tenets of Anglo-American jurisprudence and legal philosophy traditional since the seventeenth century. The purpose of the program is not to discharge employees expressly because of what they have done in the past. President Truman has stated that it is aimed at potentially disloyal persons who, because of attitudes and ideas they entertain today or subscribed to yesterday, might in the future undertake action contrary to the best interests of the United States. The basic concept of the program to ferret out the potentially disloyal violates a most important principle of Anglo-American law: that one cannot be punished for merely considering the commission of a crime, or for thinking in such a way that a body determines that one might undertake action contrary to the law. The program also violates judicial safeguards against punishment which are traditional in free societies. The rights to have a reasonable notice of charges, to cross-examine and confront one's accusers, to judicial review before punishment is meted out, to be judged by an impartial tribunal these are, among others, eliminated from the program. The program also distorts the concept of equal justice under the law.
