INTRODUCTION The right to be appointed or elected to public office is a fundamental right of citizenship that can only be infringed upon by a compelling state interest.1 While eligibility for public office is not a natural, inherent, or even constitutional right,2 a strong democratic presumption exists that any adult member of the polity is eligible to run for office.3 Public universities across the nation are currently grappling with this presumption in writing policy that restricts the right of employees to run for and hold elective office, or to accept appointed office. As this article will show, some policies do not squarely address the issue of political leave of absence, while others are either overly restrictive in terms of duration, benefits, and appointment changes, or not restrictive enough. Moreover, it is not unusual for public universities in the same state to have different political leave policies.4 As a result, public university employers and employees do not have a clear idea what their rights and responsibilities are, what procedures must be followed, and how far a university may go in restricting the political activity of its employees. This article proposes a model to assist public university officials in writing policy on political leave. This model will protect the democratic right of employees to run for and hold elective office,5 while still subjecting the employees to the reasonable control of their university employers. Most importantly, this model articulates guidelines stating the rights and responsibilities of both employers and employees, to be applied uniformly within any given state's higher education system or, ideally, nationwide. The proposed model is divided into two parts. The first part pertains to board members. The second addresses faculty members and staff. Part II of this article explains that board members can be absolutely barred from running for any type of elective office because of their status as fiduciaries to the university. Part III of this article outlines by example the rights and responsibilities of both the university and its employees wishing to run for elected office. This section demonstrates that a university may accommodate its employees' political rights, but on terms favorable to the university. By setting up specific, written guidelines consistent with fairness and public policy, public universities can maintain control over the activities of their employees, who in turn may enjoy their right to hold office. II. PUBLIC UNIVERSITY BOARD MEMBERS MAY BE ABSOLUTELY BARRED FROM RUNNING FOR PUBLIC OFFICE Public university written policy may completely prohibit board members from running for and holding elective or appointed office. State conflict-of-interest statutes support policies that prohibit board members from holding office because these board members are fiduciaries to their universities.6 Whether board members are considered public officers is generally governed by state statute.7 For example, in Kentucky, board members are not public officers;8 thus, the Kentucky Constitution's bar against public officers' holding multiple offices is avoided.9 However, Kentucky statutes make clear that a board member may not run for General Assembly while sitting on the board of a public university.10 Thus, Kentucky public universities are authorized to prohibit board members from holding elective office. Basically, since all board members of public universities are considered fiduciaries of the institutions they serve, holding public office creates a conflict of interest no matter how remote from board membership or insignificant in scale.
