- W163593032 abstract "Professor Baar's attempt to view court systems in a broad, compara tive, institutional and ecological context is at once refreshing and bewildering to those of us who have tended to adopt a narrow and piece-meal approach to the subject matter of judicial administration. The breadth of his analysis is greatly to be commended, although he covers in his paper a terrain which will, I imagine, be largely unfamiliar to many of his readers. As an English reader, I have found myself grappling with questions of a rather rarefied kind, particularly the theoretical issues of court strucure, and being repeatedly con fronted by questions which fall outside the discipline of judicial admin istration to which I am accustomed. English writers on the subject ? and I am inclined to believe the same may be said of American writers ? are much more accustomed to a functional approach which empha sizes outcome rather than structure. For English researchers, the pre occupation has not been whether the court system is unified or whether it is localized or centralized; rather the overriding concern has been more pragmatic and mundane ? to explore the mechanics of the judicial process and the way it operates. It is perhaps inevitable, therefore, that Baar's concern with court unification is in some respects puzzling to a reader, such as myself, who is familiar with the system in England ? where the notion of local justice is still very strong and where the court system is some thing of a rag-bag, reflecting as much its response to practical exigen cies throughout its history as any more positive attempts at unifica tion. Although there have been movements, as noted in the paper, towards unification in England in the nineteenth and twentieth cen turies,1 it is nonetheless difficult at times to locate the development of the English court system within the analysis presented, which seems" @default.
