- W1640372808 abstract "The paper provides for an in-depth analysis of Art. 47(1) CFR in its function as a subjective right to procedural optimization. This approach is based on positive obligations inherent to fundamental rights of the CFR and interactions with the ECHR. In concreto, the ECJ's standard of of cartel infrigement decisions is limited to a of legality and, moreover, is widely uncodified. This potentially infringes the right to an effective remedy under Art. 47(1) CFR since Art. 52(1) CFR requires that [a]ny limitation on the exercise of [a right] must be provided for by law. This, in turn, precludes the ECJ's process-oriented review in favor of applicants which is supposed to counterbalance a judicial deference to substantive outcomes. This process-oriented review is built around the legislator's obligation to show – by means of objective criteria and taking all relevant interests into account – that the weighing of diverging interests was transparent and abided by the principle of proportionality. In consequence, the lack of codification obliges the legislator to codify a – particularly precise - standard of Only then are the requirements of Art. 47(1) CFR and Art. 52(1) CFR fulfilled and only then will the ECJ be able to perform its process-oriented review. For the time being, appellants in legal procedures before the Commission and the ECJ will have to be procedurally compensated in the sense of a most-favoured-party-principle.
