- W175738205 abstract "The negotiation and drafting of relocation clauses in separation agreements is made difficult by a number of factors, including: the parties' simple dislike for such restrictions on their lives, and the parties' inability to really focus on the issue because they haven't moved around and are not plan ning to. Of course, in states with no judicial rules restricting relocation, the custodial parent has little incentive to agree to such a provision absent some quid pro quo elsewhere in the agreement. In this light, the following samples assume that such an impetus?that is a local rule or a quid pro quo? does exist. Clause 1 No removal without permission of the other party or the court. The parties have established the foregoing custody and visitation arrangements to reflect their belief that they constitute the best arrangements to meet their child(ren)'s needs to have a continuing and close re lationship with both parties, and their recognition that an arrangement that provided for less contact between the child(ren) and each of the parties would not be in the child(ren)'s best interests. Therefore, neither party shall remove the child(ren) from this state for the pur poses of changing the child(ren)'s residence to a lo cation outside this state, unless that party first obtains the express written permission of the other party to do so, or, in the absence of such permission, obtains permission of the court to do so, which permission is valid only if sought prior to the actual removal of the child(ren) and is not obtained on an ex parte basis. Nothing contained herein shall prohibit either party from taking the child(ren) from the state for brief pe riods of time such as for excursions or vacations, pro vided that the other party is told of the length of time the child(ren) will be absent from the state and the location(s) to which the child(ren) will be taken." @default.
