- W184216321 abstract "This paper examines how Supreme Court justices use language to disagree with one another. In any debate, two opposing individuals can maintain cordial, respectful differences in opinion; conversely, the two individuals could essentially go for each other’s throat using harsh, derogatory, sarcastic, or other similar types of language. Specifically, I examine what affects whether or not justices choose to attack the legitimacy of the majority opinion through the use of harsh language in separate opinions (both specially concurring and dissenting). Theoretically, using separate opinions to criticize a majority opinion can be viewed as a way in which the “myth of legality” surrounding the Supreme Court can be threatened. However, the analyses contained in this paper have found no evidence that Supreme Court justices are concerned about how the public may view their attacks on the legitimacy of the majority opinion, though, interestingly, neither does ideological distance appear to affect whether or not a justice attacks the legitimacy of the majority opinion." @default.
