- W1894275445 abstract "International law finds itself in the process of continuous development and growth and is often characterized by the process of fragmentation. An example can be observed in the field of international regulation: its changing nature, its advancement beyond the frontiers of sovereign states and the involvement of actors other than state parties or governmental agencies in the drafting of rules. The problem with these developments is that state consent and legality through contract-type instruments are no longer sufficient to legitimize these new types of regulation. One approach aiming to fill this legitimacy-deficit is the development of a system of procedural instruments: mechanisms, principles and practices that can make those responsible for this regulation somehow accountable for their actions. This thesis explores whether there is in fact an emerging trend in international law, and environmental law in particular, towards a system of Global Administrative Law. This is done by means of a short case-study within a hybrid regime of forest certification that has been constructed in the past two decades with the goal to combat deforestation and promote sustainable forest management. Current theories about this concept are explored together with an attempt to answer a number of fundamental questions concerning the concepts of legitimacy and accountability and their relationship with justice, the extent of the legal order in question, and an exploration into the amalgam of available mechanisms, principles and practices. The case study will consist of a descriptive and an analytical part: the first part describing the overall features of this hectic regime - including an inquiry into the concepts of sustainable development and sustainable forest management - while the second concentrates on analyzing the regime against the procedural instruments distilled from the previous chapters, namely transparency, public participation and (judicial) review." @default.
