- W1898843997 abstract "This essay aims at describing how the perception of violation compensation has developed from medieval times up to today, using the perspective of sexual crimes, in particular rape.The main focus of this paper is on the opportunities and rights for victims of sexual crimes to receive violation compensation, dealt with under chapter 2 § 3 and 5 chapter 6 § in the law of damages (SkL) but also includes the regulations dealing with pain and suffering (chapter 5 § 1 p. 3 SKL). Violation compensation has strong links with historical criminal and tort law. To give an overall picture of sexual crimes and offenders, the essay starts with a description of how the perception of rape crimes, victims and perpetrators has changed over time, sometimes exemplified by rape cases from published lawsuits. Since it is difficult to measure the direct damage caused by rape, the new law calls for a more objective assessment of compensation for violation making the perpetrator's behavior a central issue. This important role of the perpetrator means that the interaction between tort law and criminal law becomes particularly clear for rape crimes. Different aspects of tort law will therefore be discussed in more detail as well as elements of criminal law.
