Crucial in the sense that it plays pivotal role in identifying the party who is supposed to discharge the burden and hotly debated in the sense that it barely remain constant with one party and keeps changing hands through out the trial. In this sense this paper (Shifting of Burden in Criminal Cases) deals with the very issue aligning the principle with the Nepalese legal system. In the first part of the paper, the paper creates the backdrop of criminal trial and creates the place for the principle of burden of proof in criminal trial. Furthermore the paper in this part also raises the most contested issue in burden of proof that of shifting of burden, in criminal trial for further consideration in the paper. In its second part the paper describes the true sense of burden of proof and its forms and scope in criminal trial. Then in the third part of the paper, it is shown how and why does the burden shift in the criminal trial and how should it be coped so that to arrive at right decision at the end of the trial. And in its fourth part, the paper briefly analyze Nepalese legal system and judicial trend towards burden of proof, especially shifting of burden in criminal trail with case laws and relevant legal provisions. Finally the paper concludes with the acknowledgement of both pros and cons of shifting of burden in criminal trial and suggests some precaution against the possible wrongdoing of the shifting of burden in criminal trial." @default.
