- W191915180 abstract "In the United States, corporate persons and human persons are held to different standards and assembled differently under the law. Corporate persons experience different mandates, duties, and rights under the laws of the United States, particularly in the area of debt and debt relations. Human persons experience a melding of the moral and the financial in debt relations in that their debt repayment behaviors are measured against a standard of morality. Corporate persons’ behaviors in debt relations, on the other hand, is viewed purely through the lens of finance: “it is just good business,” “economic sense,” or “nothing personal — it’s just business.” In no other area of law is this more pronounced than in the context of bankruptcy. The provisions of the Bankruptcy Code that were either enacted in 1978 or added over the last thirty years reflect a trend or shift in the social, economic, and political world. The corporate protectionist provisions found in the Bankruptcy Code are part of the shift, over the last three decades, in the larger processes of capitalism and the shift toward new economic models. What is most apparent is the protection of capital against the incursions of labor and the work force. The U.S. Bankruptcy Code and Bankruptcy Court case law is one area of the American legal system that provides the corporate person with increased protections, rights, and powers when compared with the protections, rights, and powers of human persons." @default.
