- W1965222073 abstract "The growth in firearms case filings, together with factors such as the number of defendants per case, number of jury trials, and length of jury trials have placed an increasing burden on federal court resources. A central component in both the growth and the complexity of these firearms cases has been the use of 18 U.S.C. § 924(c) by federal prosecutors. In the first half of the 1990s, cases involving § 924(c), which enhances the penalties for defendants who use a handgun or rifle in a violent crime or a drug trafficking crime, grew significantly, then dropped in 1996 as a result of Bailey v. United States. From 1997 to the present, the use of § 924(c) has remained fairly constant, though in the aftermath of Bailey, motions to vacate sentence under 28 U.S.C. § 2255 spiked, and the number of firearms appeals in the federal circuit courts grew. With some of the inconsistencies in post-Bailey § 924(c) district court rulings resolved in Muscarello v.
