- W1971693378 abstract "In her Commentary on the Symposium on the Boundaries of the WTO that was published in the American Journal of International Law, the former Director of the WTO Appellate Body Secretariat, maintains that the question is not whether or not the WTO should deal with the “trade and …” subjects such as trade and environment, trade and public health, trade and competition, trade and human rights, trade and competition, etc. . It already does. The important questions are: How should these non-trade subjects be dealt with within the WTO system? And who should define the scope of recognition of those subjects: the Members or the dispute settlement bodies? The WTO Agreement is not a contract, but is a treaty containing rules and obligations binding in international law.
