- W198037142 abstract "Courts in America by and large provide their services at nominal cost to users, reflecting the underlying premise that courts are a public service that the public as a whole should fund. This traditional view may merit re-examination at a time when the funds required for court operations are increasing while those available are growing more scarce. This inquiry questions the underlying assumptions of the current system and suggests types of user fees that might be imposed at least on some court users. In many courts throughout the country-trial and appellate-the dock ets are full, the waiting time is extended. Moreover, the public funds spent to keep the courts open and functioning are growing apace with the volume of business (see, e.g., Association of the Bar of the City of New York, 1980). The increase in the costs of maintaining our courts partly reflects our litigious society (Lieberman, 1981). Use of the courts is stimu lated by our belief in fairness and equity and our habit of looking to the courts as a forum for adjudicating a wide range of disputes. The courts themselves have contributed to their workload by expanding their own jurisdiction through recognition of new areas of individual rights and due process. The increased burdens placed upon our court system have created a new challenge. Formerly, the public funds used to maintain the courts were too small to deserve prolonged scrutiny within the overall government budget. Compared with other budget items, the courts' budgets are still small, but they are surely a more prominent item than they once were, all the more so since every object of public spending is subject to challenge in the effort to close the gap between revenues and outlays. These increasing - and increasingly visible - costs have spawned various strategies to reduce or reallocate them. Centers for training judi cial branch personnel have developed and a strong movement toward increased professionalization of judicial administration has occurred. Legislatures have reorganized the courts to provide more centralized management of basic administrative tasks and thus to achieve, among other things, certain economies of scale." @default.
