- W2016288066 abstract "The current difference of opinion between the Intellectual Property Board and the Chartered Institute of Patent Attorneys (CIPA) as to what may constitute a conflict of interest and how it should be handled is symptomatic of a broader lack of understanding among professionals, courts, and regulators. Such disagreement is illustrative of apparent discrepancies between law and practice. This article sets out the main issues that can arise for IP practitioners in relation to conflicts of interest and suggests some practical ways that they can be easily identified and managed. Practice in the IP area is more fraught with conflict of interest issues than many other areas of professional advice because practitioners seek to achieve broad and exclusive property right protection for their clients, proprietary rights that are limited by and impact upon the scope of later patents. The dire consequences for the IP professional who falls foul of the law on conflicts of interest include a civil action for damages for breach of contract, negligence, or breach of fiduciary duty; court proceedings restraining the practitioner from acting, or disciplinary hearings for breach of the relevant codes of conduct. An associated consequence is the cost and embarrassment of such proceedings. The following discussion considers the degree to which the duties owed by lawyers may also be imposed upon non-lawyers practising as patent or trade mark attorneys. For brevity, the discussion refers to patent attorneys and patents, but the same applies to trade mark attorneys.
