Public policy in the United States in recent years has clearly moved toward tightening the regulation of retail sale of alcohol (Langenbucher. 1982). As a result, about 95% of the more than quarter-million retail liquor licensees in the United States are now vulnerable to criminal prosecution under alcoholic beverage control (ABC) codes for serving alcohol to persons. Moreover, a sizable proportion ofthe nation's 80,000,000 householders can be pros ecuted under the same criminal codes for serving alcohol to guests. Agreement on the ap plicability of civil liability is less uniform. Twenty seven states and the District of Columbia, under Dramshop Acts or their common-law equivalents, will entertain damage claims against retailers who serve alcohol to patrons. These retailers comprise a majority of the nation's licensed bever age distributors. Dramshop Acts or their common law equivalents will also allow civil action to be brought against householders in some states for serv ing liquor to guests, while the applica bility of these regulations in other states to addi tional private hosts is unclear. It seems to be society's unmistakable wish that large numbers of people, retailers and private citizens alike, be held to strict account for serving alcohol to int'Jxic,lt<.::d persons." @default.
