Regrettably, these fears sometimes become reality. In its most egregious forms, gross abuse, neglect, and exploitation involve a level of intent by the perpetrator to do harm. Abuse may involve infliction of injury, unreasonable confinement, intimidation, or cruel punishment with resulting physical harm, pain, or mental anguish.Nearly forty years ago, under the Older Americans Act (OAA), the federal government established the Long-Term Care Ombudsman Program to address widespread problems of abuse, neglect, and substandard care in America's nursing homes. Today it operates in every state, the District of Columbia, Guam, and Puerto Rico through a network of 578 local ombudsman programs with more than 8,800 trained volunteers. These advocates provide a regular presence in long-term-care facilities, identifying and effectively resolving issues related to resident care, protecting residents' rights, and helping to improve quality of life for residents of nursing homes and other long-termcare facilities.Risk Factors for Abuse in Nursing HomesIssues with the facility, the residents, and resident relationships can all be risk factors for abuse. Residents' families, facility administration and staff, advocates, and the residents themselves should be aware of such potential risk factors and act to ameliorate them. Facility risk factors can emanate from poor staffing, poor supervision, and disengaged administration. A lack of screening when hiring, poor training in abuse prevention, and staffstress and burnout can all create an environment that puts residents at risk.Residents who have dementia and behavioral issues are at greater risk of abuse, neglect, isolation, and discharge than other residents. Staffmust undergo special training to understand the specific needs of these residents and create an environment that promotes the highest level of independent functioning and quality of life.Relationship factors may also affect the risk of abuse or neglect. It is well known that residents who do not receive regular visits from family, friends, or others outside of the facility are at higher risk of receiving poor care because no one is monitoring their situation and speaking up on their behalf. Also, resident-staffinteractions may be affected by past negative encounters or because staffmembers are too busy to take the time to understand residents' preferences.Statistics of Abuse Complaints in Nursing HomesReports of abuse, gross neglect, and exploitation represented 7.1 percent of all nursing home complaints received by the Long-Term Care Ombudsman Program in 2010. And according to the most recent Administration on Aging (AOA) National Long-Term Care Ombudsman Program Report (2010), physical abuse continues to rank among the most frequent nursing home complaints received (fourteenth out of 115 complaint codes). The top twenty complaints represent 57.9 percent of the 157,962 nursing home complaints received by ombudsman programs nationally-a significant number. Depending on the state, ombudsman programs may investigate complaints of abuse and neglect, refer such allegations to local Adult Protective Services offices and designated state agencies, or jointly investigate allegations with other agencies. The AOA report also captures complaint data on other types of abuse and neglect in nursing homes, including verbal-mental abuse (ranked at number twenty-two); gross neglect (ranked at number thirty-four), and sexual abuse (ranked at number fifty-one).The good news is the number of physical abuse complaints reported to the Long-Term Care Ombudsman Program has decreased over the past five years, from 4,137 in 2005 to 3,245 in 2010.
