- W2074752188 abstract "Compliance may be viewed as one possible response of parties involved in a court case to the decision handed down by a judge or a jury. The ability to assess compliance depends on such factors as the complexity of the case and the nature of the behavior required of the defendant. If, for example, the court involved is the United States Supreme Court and a response is required of a whole class of persons, say all school superintendents in the country, then compliance is much harder to measure. The problem is magnified if different defendants in varied jurisdictions are involved. Much of what are reviewed in this paper, then, are studies that focus on a somewhat elusive phenomenon. Social scientists have not looked at court decisions merely with compliance in mind. Some studies, for example, have looked at the of court decisions, considering how people's behavior and attitudes on social issues might have changed as a result, or how people's attitudes toward the court as an institution might be altered. Ultimately these broader questions address such fundamental issues as what is the role of the courts themselves, compared with other branches, whether increased legalism advanced individual rights, and of special interest to educators, how increased litigation changes the roles of those involved with public policy. There is not, for reasons which will become evident, any one theory or set of mutually agreed upon research questions that have guided researchers working in this area.
