- W2088890112 abstract "Is it possible to develop a constitutional theory of contemporary American federalism that accounts for today’s facts on the ground, i.e. the overlapping, intertwined and competing nature of the national and state governments in the United States? That is precisely what Robert A. Schapiro attempts to do in this ambitious and thoughtful volume. A legal scholar, who (unlike most law professors) is familiar with the basic federalism literature in political science, history, and economics, Schapiro proposes a “polyphonic” understanding of federalism that promotes and sustains multiple nodes of power operating in the same substantive policy areas. He believes there remain very few political and cultural differences among the country’s states and regions. But he maintains that federalism is still important because it is entrenched in the Constitution, it can lead to better governance, and it protects fundamental rights. Schapiro proposes “a model of federalism that replaces an outdated focus on local variation with an emphazis on the organizational benefits of multiple agents of power,” and he argues that the real power of federalism is its “organizational ingenuity rather than its nostalgia for lost community” (p. 7)." @default.
