- W2092034249 abstract "Two hundred years ago, the drafters of the Constitution provided protection from unreasonable government intrusion. Roughly 100 years ago, the common law began to develop in the area of protection against unwanted, unwarranted invasion of privacy from non-government parties. On a parallel path, state and federal action added statutory protections. Still, given the need to balance countervailing forces, these protections are never absolute. For example, First Amendment protection of the press presents a powerful pull for the news media and allows certain invasion of one's privacy. But what about the individual who decides to sell his or her name or likeness—in the form of endorsements? In addition to the right to contract and the law of copyright and trademark, is there protection for individuals whose name or likeness is first used by the news media and then reused for advertising purposes—without the individual's consent? As with all areas of the law, it depends. The right to publicity, a developing area of the law, offers new protection. However, the result turns on each set of facts and state-by-state determinations. The following article discusses the evolution of this new right and the considerations involved in asserting and defending the right.
