- W2092886859 abstract "Is the state a foundation of private law reasoning, and, if so, in what respect? This article contends that there are essentially four different basic perspectives which legal reasoning can take and that they rely on the state to a significantly different degree. What is called the internal perspective largely depends on a state legislator who provides the basis of validity, keeps fragmentation of the law within narrow confines, and allows for the fiction of a sovereign with a coherent set of preferences, expressed in private law principles and policies. With a decline of the state, it is to be expected that classical legal reasoning from the internal perspective will change its face. Very likely, a type of legislative and methodological tools which, in this article, are called transmission links will become of greater importance. It is also to be expected that actors will borrow paths and tools of legal reasoning from the other perspectives, in particular from the external and the sovereign perspective. Another possible scenario is enhanced self-referentiality and cross-referentiality among the different perspectives, leading to more or less autonomous private law reasoning." @default.
