Galba, the orator and praetor of 150 B.C., was the latest of the Roman aristocrats to be judged apud populum. Later on, the aristocracy managed to transform the quaestio, originally a preliminary phase where only the evidence was exposed, into a real trial, where the indices were chosen among the names submitted by those same ordines. As a result, most verdicts were controlled by nobiles, whose sense of justice was different from the rest of the people. This paper shows that a more accurate understanding of popular conceptions of justice derive from the triumvir's coercitio than from the candid assertions made by Classical writers on the subject." @default.
