- W2113271454 abstract "The acquisitive prescription of Korean civil law and the adverse possession of U.S. law are quite similar to the background reasons, targets, effects even though there is huge difference of public notice, transfer of title, and recording system. One of the biggest points of difference is the necessity of recording. In Korea, the possessor has to record if he or she wants to own the land officially due to acquisitive prescription. In the U.S., however, adverse possessor doesn’t need to record to get the ownership of the land. The adverse possessor can get the perfect title as long as he satisfies elements of adverse possession. Furthermore, the U.S. adverse possessor cannot acquire government land due to adverse possession. However, the Korea acquisitive prescription allows taking the ownership of government-owned land only if the land is a mixed-breed property. The most confusing element of adverse possession is the adverse possessor’s state of mind. There are 3 different approached to the issue. The majority of states follow an objective test, i.e., the adverse possessor’s state of mind is irrelevant. Several states use a good faith test. Although academic commentators generally argue that the subjective mental state of the possessor should be irrelevant, the courts seldom allow a bad faith possessor can have the ownership of the land. In England, the way to acquire the ownership of the land by an illegal possessor became very hard due to recent modification of the law. They think a negative effect of adverse possession became bigger now when compared with the past situation in which positive effect was big due to an incomplete recording system. Recently, Korea Supreme Court changed the attitude of acquisitive prescription. In the past, possessor without consent of the owner can argue acquisitive prescription. However, the possessor without consent of the owner cannot get the ownership of the land due to acquisitive prescription now. I think the court and the legislative current trends is right given the stable situation of recording system and importance of protecting the true owner rather than illegal adverse possessor." @default.
