According to those agreements, some intermediate zones or provisional measures zones were established in the overlapping zones in the seas of Northeast Asia. It was because three coastal States agreed to shelve delicate issues on maritime boundary delimitation during transitional period. Now that three bilateral fisheries agreements are in effect among Korea, Japan, and China, each of the three states has the obligation of establishing a new fisheries system in Northeast Asia and preparing for future maritime delimitations through the efficient operation of these agreements. Maritime delimitation is crucial to the distribution of maritime jurisdiction among coastal states. For this reason, each coastal state attempts to place under its jurisdiction as broad a maritime zone as possible by asserting delimitation criteria that are advantageous to itself. The approaches adopted by Korea, Japan, and China toward maritime delimitation fall in line with this trend. China, for example, places weight on geographic conditions such as the coastline length or seabed configuration and thus calls for the equitable principles; Japan, on the other hand, emphasizes the equidistance principle. In addition to each state’s conflicting positions on the basic principles of maritime delimitation, delimitation in Northeast Asian waters entails a number of other pending issues. These include the treatment of disputed islands, the handling of the trijunction, or the area to which the three countries have common claims, and the delineation of the relationship between existing continental shelf boundaries and new EEZ boundaries. It is a formidable task to resolve delimitation issues rationally in a short period of time when each coastal state’s positions are entangled. At this juncture, it would be worth recalling the fundamental meaning of maritime delimitation per se to the coastal states in Northeast Asia. The significance of maritime delimitation in semi-enclosed seas, namely those of Northeast Asia, ultimately lies in the establishment of a rational maritime order through the efficient allocation of jurisdiction or maritime resources. The question that arises here is whether states must go as far as seeking maritime boundary delimitations at the risk of stirring up territorial controversies, which can never bring satisfactory outcomes to all the coastal states involved, if it is possible to establish a sound maritime order without clear-cut delimitations. In short, realistically, it would be optimal for the states involved to come up with a means by which to efficiently exploit and utilize maritime resources while at the same time settling territorial disputes over islands in a roundabout way." @default.
