- W2153300543 abstract "This paper examines the role of litigation in citizens’ campaigns to hold the government accountable for the harmful consequences of its decisions. Legal mobilization, because it involves coordinating litigation with publicity-oriented activities, bolsters the credibility and salience of plaintiffs and their cause in a variety of ways. The lawsuits, and the public outrage against the government, and victims’ lobbying efforts alert politicians to problems that need attention, from among the multitude of potential issues to tackle. By enhancing the credibility and salience of their cause through legal mobilization campaigns, plaintiffs can simultaneously mobilize public sympathy to shame the government and recruit political allies who can engineer redress legislation. Drawing evidence from four health-related victim redress movements in Japan, this paper demonstrates that the 1994 electoral reforms facilitated the use of legal mobilization as one way for redress claimants to recruit political allies. This paper highlights three developments. First, each politician must now appeal to broader, more diverse set of constituents. Second, more centrist and more viable alternative parties now compete for support from the median voter. Third, the prime minister and party leaders now bear more responsibility for decision-making and the party image. Together these effects of the electoral reforms have increased the likelihood that politicians will champion plaintiffs’ causes." @default.
