- W2163209346 abstract "In April of 1873, the United States Supreme Court rejected Myra Bradwell's claim that the right to practice law should be acknowledged as one of the privileges and immunities of United States citizenship. Thus, the first case of sex discrimination to be heard by the Court was resolved against the woman, as would be every subsequent claim but one for the next ninety-eight years.1 Delivered at the same time was the ruling in the Slaughter-House Cases,2 which gave a restrictive reading to the seemingly expansive language of the new fourteenth amendment. These two cases had been under simultaneous review by the Court for nearly three years. Their main issue was identicalcould a state restrict the right of a person to pursue his chosen occupation? In both cases the Court said 'yes'. Although the legal effect of these cases has now been ameliorated, a study of Bradwell's litigation illuminates both the process of judicial decision-making and the efforts of women to gain access to the legal profession in the nineteenth century.3 Myra Colby Bradwell fought for reform in two primary ways-through the courts as a litigant and through the legislature as an advocate of diverse reforms. Perhaps the greatest effort of her life was directed toward changing the ideas of male lawyers and judges concerning the abilities of women. Justice Holmes's statement rings true: 'The rational study of law is still to a large extent the study of history . . .
