- W2190139814 abstract "Throughout the world, and more recently in East Asia, it has become increasingly popular for countries to incorporate detailed competition related provisions (CRPs) in their Free Trade Agreements (FTAs). For instance, recent FTAs between East Asian countries, such as the Japan–Viet Nam Economic Partnership Agreement (EPA) and the China–Korea FTA, contain independent competition chapters. Moreover, as CRPs have become more common in FTAs, scholars have begun to categorize them in order to better grasp the trends in these agreements; one such study was conducted by Solano and Sennekamp in 2006. Their taxonomy, however (the basic concept of which is supported by a variety of different scholars), focused only on the dichotomy between EU-style and North American-style provisions while largely ignoring Asian FTAs. This is because, at the time of their work, the only countries in East Asia that had entered into FTAs with CRPs (specifically ones that featured a competition chapter) were Japan, South Korea, and a few Association of Southeast Asian Nations (ASEAN) member states. Since then, however, more East Asian countries have begun to enact domestic competition laws, and as a result, CRPs have become ever more popular in their FTAs. In light of these developments, this paper examines the CRPs in East Asian FTAs and attempts to categorize them based on an earlier taxonomy. It is interesting to note that while some FTAs fall easily into either the EU or North American families, others defy this classification and belong to a third category, “hybrid style.”This paper also discusses the Trans-Pacific Partnership (TPP) and the Regional Comprehensive Economic Partnership (RCEP), as they may affect CRPs in East Asian FTAs. For instance, the considerable influence of the US in the TPP negotiation may lead the CRPs in East Asian FTAs to more closely resemble North American CRPs. Meanwhile, the ongoing RCEP negotiation suggests that the EU style may come to influence these provisions, which would again imply the emergence of a “hybrid style.” While it would seem that mega FTAs would allow CRPs to become uniform, the varying motivations behind them may prevent such a convergence." @default.
