Legal precedents have established the right of any person over 25 to undergo voluntary sterilization; those under 25 may undergo sterilization only in the case of a medical, genetic, or criminological indication. The German Physicians' Congress, however, has declared its opposition to performing sterilizations except under medical, genetic, or serious social indications. A physician is legally responsible for mistakes made in the post-operative treatment period of a serilization operation. If a physician does not sufficiently inform his patient about possible consequences of a sterilization operation, he can be held responsible for complications, even if he has the patient's written acknowledgement that such counselling did take place. The physician is not responsible for unforeseeable injuries to a patient's health, unless he had failed to inform her fully about the operation's possible consequences. A ruling from a state Supreme Court has maintained that the birth of an unwanted child to a legally married couple cannot be construed as a damage and that no third party, e.g., a physician who had performed a sterilization operation on the patient, could be held responsible for the child's upkeep." @default.
