- W2199452886 abstract "This article (1) examines the relationship between the ideas of and of and (2) questions the view that United States society has suffered a general reduction in these two principles over the last century or so. The article surveys some of the philosophical literature on and concludes that there are a number of important disagreements as to what means. Similarly, definitional problems can cloud the meaning of of contract. These conceptual and definitional issues make a direct association between freedom and freedom of contract problematic. More freedom of contract does not necessarily mean more freedom. The last part of the article examines cases from the 1880s in which contracts were challenged on public policy grounds. The article concludes that these cases do not support the view that we have seen a general reduction in freedom, or even freedom of contract, since the Golden Age of Contract in the latter years of the 19th century." @default.
