- W2199546355 abstract "An action in negligence raises a number of issues: (1) Will the courts, as a matter of policy, not impose a standard of care where, for example, public officials must be free from concerns about legal liability for the judgement calls they make in good faith?(2) Is there a foreseeable risk of harm?(3) What standard of care will the courts impose in regard to the risk? (4) Is the actual conduct of the defendant a departure from that standard of care? (5) Is there a cause-effect relationship between the conduct of the defendant which was a departure from the standard of care, and the loss of the plaintiff? (6) Is the relationship between all of the damages suffered, foreseeable or unforeseeable, sufficient to justify recovery or is the loss too remote from the initial fault? There is much confusion in the case law because the four issues, 1, 2, 3, and 6, are discussed in terms of duty language. The classic example is in regard to economic loss where some courts treat it as a number 1 problem, holding that the law of negligence doesn’t apply to pure economic loss except in terms of a few limited exceptions, while other courts treat it as a 6 problem, ruling that the law of negligence imposes a general liability in regard to pure economic loss but place limits on recovery in terms of remoteness. Both conflicting analyses are justified in terms of duty language. A careful examination of the cases in terms of the analysis of the above six issues demonstrates that the law of negligence applies to pure economic loss, and the extent of the loss is a matter of remoteness. Where ever duty language appears in the case law relating to negligence it is important for the sake of clarity to examine whether the problem is of the nature of 1, 2, 3, or 6." @default.
