- W221410674 abstract "A key tenet of administrative law is that where Congress has given an agency the power to interpret the statute, courts should give “Chevron deference” to the agency’s reading of the statute and consider the agency’s interpretation binding. Several authors have argued, however, that the Supreme Court does not give the Equal Employment Opportunity Commission (EEOC) Chevron deference its interpretations of law as the Court does with other agencies, calling the EEOC a “second class” agency. Focusing on agency interpretations of Title I of the Americans with Disabilities Act and its amendments, this paper argues that these authors are mistaken by failing to take into account what has been academically characterized as “Chevron step zero.” Chevron deference only applies to situations where Congress explicitly or implicitly delegates the ability to render binding interpretations of statute to agencies. The Court has been consistent that absent such a delegation, it is under no obligation to defer to agency interpretations. This paper argues that whenever the Supreme Court has faced the issue of whether to defer to an interpretation of the ADA by the EEOC, the Court has applied Chevron step zero to determine the amount of deference owed to the agency. Where the EEOC’s interpretation has passed Chevron step zero, the Court has applied Chevron deference. Where the interpretation has failed Chevron step zero, the Court has applied a lesser standard of deference." @default.
