Within five years of his prescient warning, the stock market peaked, the Dot-com bubble burst and the markets were “corrected”. The socio-politically painful J-Curve of global economic rehabilitation notwithstanding, one may, at least take some little comfort in the federally accepted notion that the financial impact of “irrational exuberance” is something to be mitigated or “corrected”. Turning to federal sentencing, a system at the whims of “tough on crime” legislators, prosecutors, judges and a public torn between apathy and puritanical righteousness, the process of correcting decades of misguided and ineffective penological policy has been almost at an impasse. While much of the academic debate over the past seven years has been focused on the Supreme Court’s landmark decision in United States v. Booker and its progeny, which rendered the United States Sentencing Guidelines (hereinafter “Sentencing Guidelines” or “Guidelines”), originally established by the Sentencing Reform Act of 1984 (“SRA”) “advisory,” these debates belie a more fundamental problem inherent in the federal sentencing guidelines: an impressive dearth in rationality and common sense, free from political and populist pressure." @default.
