- W2244124699 abstract "In 2007, Montana sought leave to file suit against Wyoming in the Supreme Court alleging violations of the Yellowstone River Compact, the interstate agreement negotiated over fifty years ago that allocates the water of the Yellowstone River and her four tributaries between the states of Wyoming, Montana, and North Dakota. Although the complaint only appeared in front of the Supreme Court in 2007, the conflict over the area’s water resources has been going on for decades. In an arid area with expanding populations, new industrial development, and established agricultural interests, water is taken very seriously. So seriously, in fact, that journalist Lorna Thackeray described the filing of the suit by saying, “If Montana and Wyoming were independent nations, troops would be lined up at the border waiting for an order to fire . . . . Wars have been fought for less.” The Yellowstone River Compact itself does not specifically mention groundwater. Montana, however, alleges that Wyoming’s groundwater withdrawals (mostly related to the development of coalbed methane in the Powder River Basin) reduce the amount of Powder and Tongue River surface water that crosses into Montana. In years when Montana does not get its stipulated allocation of Powder and Tongue River surface water, Montana considers those Wyoming groundwater withdrawals causing reduced surface water flows to violate the Compact. Wyoming, on the other hand, asserts that the Yellowstone River Compact does not cover groundwater. The lines are drawn, and both sides have eagerly anticipated the release of Special Master Barton Thompson’s report and the Supreme Court’s response to it. The aim of this paper is to critically analyze the Special Master’s conclusions about the place, if any, that groundwater withdrawals have in the Yellowstone River Compact. In order to do so, I begin in the first section, The Yellowstone River Basin Water War, by outlining the history of the document at the heart of this matter, the Yellowstone River Compact, as well as the events leading up to the current litigation. In the second section, I discuss the conclusions of the Special Master as put forth in his First Interim Report, released in February, 2010. In the third section, Groundwater and Interstate Water Adjudications, I review at the Supreme Court’s previous jurisprudence to determine how they have addressed whether this jurisprudence presents the best method for dealing with groundwater. In the last section, I return to the Special Master’s recently released report in order to determine how the Supreme Court should respond to its recommendations. I come to the conclusion that the Supreme Court should uphold the recommendations of the Special Master and hold that diversions from groundwater hydrologically connected to Compact-controlled surface waters violate the Yellowstone River Compact." @default.
