Given the fact that most of the drink drivers have no motivation to engage in training programmes we looked for possible incentives and teachable moments which can be used to attract drink drivers to those treatments. By establishing a network between the police, the public prosecutors, the court and providers of training programmes offenders should have easier access to information. The low participation rate may be attributed to lack communication between delinquents and judicial and administrative authorities. Our intention is to initiate problem awareness, get more people into preventive and rehabilitative treatment programmes, to change problem behaviour, to avoid an escalation of problems and to reduce relapses. The theoretical background focuses on psychological stage and phase models of change and the theory of planned behaviour (AJZEN, [2]). The prevailing jurisdiction reveals an inconsistence between criminal and administrative law concerning the appraisal of driver aptitude. If a reduction of the retention period is ruled there must be reasons for the assumption that driver aptitude is restored. If these reasons exist they are clearly judged differently.
