- W2247706717 abstract "When we learn the law, we learn emotionally; further, what we are learning has emotional content. Teachers of the law can tap into the affectivity of both the mode and the content of learning more or less effectively. Certainly, the learning experience can be greatly enhanced by teachers becoming more aware of the role of the emotions in learning law. The devil, of course, is in the details. The focus of this contribution is to bring out some of these details by way of offering an account of the relationship between legal understanding and the affective imagination. The paper is divided into three parts. In the first, the relationship between understanding and the imagination is examined. More specifically, it is argued that the content of concepts – as well as that of terms and phrases generally – is inherently ambiguous, necessarily incomplete and always shot through with unforeseen possibilities. It follows that the understanding of concepts depends to a large extent on one’s willingness and ability to creatively and actively explore possible instantiations of the concept. This account of the importance of the imagination applies to understanding in the general sense, but also to the more specialised understanding required by legal practice. The second part of the paper then turns to the affective dimension of this imagination, and thereby also to the importance of the affective imagination for legal understanding. A specific example is examined: it is shown how the understanding of the concept of ‘concerted practice,’ which is a central concept for competition law (or anti-trust law in the United States), can be enhanced by the affective exploration of its possible affective instantiations. In the third and final part, the lessons of the first two parts of the paper are brought together and summarised, and some concrete recommendations for the development of the affective imagination in the teaching of law are made." @default.
