- W2278232084 abstract "On June 2, 2003, the FCC voted 3-2 to loosen several long-standing rules that govern media concentration in the national and local broadcast markets and cross ownership restrictions between broadcasters and newspapers. The FCC amended the rules to raise the audience reach from 35 percent to 45 percent and allow one company, in some larger markets, to own the local newspaper and several television, radio, and cable stations. Congress passed a statute that rolled back the audience reach to 39 percent, but left unaltered the cross ownership rules. The Third Circuit remanded the cross ownership rules to the FCC for failing to adequately support its decision. However, the Third Circuit agreed that a blanket ban on cross ownership was not justified in the public interest. In making its initial deregulatory decision, the FCC relied on market convergence theory to justify the regulatory relaxation. Pursuant to this theory, the FCC in essence found that one media market existed encompassing broadcasting, the Internet, cable, and Direct Broadcast Service. In fact, the FCC believed that one consolidated media market would leave the media consumers unharmed and free to enjoy competing media substitutes. This article analyzes how the FCC failed to appropriately use antitrust theory in its deregulation order by failing to examine the submarket of minority media consumers. The FCC failed to take into account the insufficient substitutes available to media consumers of color, i.e., African Americans and Latinos/as who have far lower rates of home access to the Internet than Asian Americans and Whites and lower overall rates of access. The FCC also failed to consider that in-school and library access to the Internet were inferior forms of access and did not compare to broadcast television, which is present in 99 percent of homes in the United States. Unlike broadcast television, relying solely on in-school or library access would make it impossible for those consumers to access vital and important information when the library and schools are closed.
