- W2278744671 abstract "With the 1995 Agreement on Trade - related Aspects of Intellectual PropertyRights (TRIPS), a centralised rule - system for the international governance ofpatents was put in place under the general framework of the World TradeOrganisation (WTO). Since then, the number of patent – related institutionshas increased monotonically on the multilateral, plurilateral and bilaterallevels. I will explain this case of institutional change by focusing on the norm– setting activities of both industrialised and developing countries, arguingthat both groups constitute internally highly cohesive coalitions in globalpatent politics, while institutional change occurs when both coalitionsengage in those negotiating settings in which they enjoy a comparativeadvantage over the other coalition. Specifically, I make the point thatindustrialised countries’ norm – setting activities take place on theplurilateral and bilateral level, where economic factors can be effectivelytranslated into political outcomes while simultaneously avoidingunacceptably high legitimacy costs; whereas developing countries, on theother hand, use various multilateral United Nations (UN) forums where theirclaims possess a high degree of legitimacy, but cannot translate intoeffective political outcomes. The paper concludes with some remarks on howthis case yields new insights into ongoing debates in institutionalistInternational Relations (IR), as pertaining to present discussions on “regimecomplexity”." @default.
