- W2280214519 abstract "Any historian who wishes to write a history of sexuality from below following a qualitative approach, has to deal with the problem of finding reliable sources. Virtually the only access to the sexual perceptions of concrete individuals in the past, is through documents produced by social elites and/or the state, such as criminal records of sexual offences. Without a thorough historical criticism these distorted sources cannot serve as the basis for a history of mentalities. The methodological suggestions presented here include on the one hand a close reading aimed at the identification of the discursive characteristics of depositions and on the other the analysis of the social context in which these police interviews were produced, in this case the unequal power relations in the interrogation. The record of a testimony is in effect a double-voiced text: it reads as a monologue by the person questioned, but in fact it is the result of a dialogue with the interviewer. The account of the interviewee suffers from 'judicial contamination' and only reaches the historian through the written version by the authorities. Carlo Ginzburg's method of 'reading the gaps', looking for inconsistencies in the discourse, allows us to distinguish the two different voices. The questioner does not only determine the form but also the content of the testimony in order to establish the occurrence of a sexual offence. The uneven balance of power in the interrogation has to be brought into account. Using Michel de Certeau's concepts of 'strategy' and 'tactics' we can map out the bias of discipline and resistance. The analysis of a few criminal records from the interwar period thus reveals a strategic and gender specific 'will to know'. The importance of female chastity in the bourgeois sexual ideology, as translated into criminal law and legal doctrine, meant that the sexuality of the female victim was far more excessively questioned than that of the male perpetrator. However, the offenders as well use this gender inequality in attempts to escape their responsibility for the charges.
